This presentation will include a review of the cases applying the changes to Chapter 11 caused by the Bankruptcy Code amendments enacted in 2005 as it relates to individual Chapter 11 cases.

This discussion will cover attorney engagements with individual debtors, compensation of professionals in individual cases, the peculiar tax issues involved in such cases, the restrictions on the payment of expenses during the Chapter 11 case, the confirmation of individual Chapter 11 plans, and the rules on modification of Chapter 11 plans and the entry of a discharge order at the conclusion of a Chapter 11 case.

William L. Norton III, is a member in the Nashville, Tennessee office of Bradley Arant Boult Cummings, PLC, 1600 Division St., Suite 700, Nashville, Tennessee 37203, which he joined in 1984. He practices in the commercial finance area and focuses primarily in creditor’s rights and insolvency law.

Mr. Norton is certified as a business bankruptcy law specialist and is an adjunct professor at Vanderbilt University School of Law. He is the Editor in Chief of Norton Bankruptcy Law & Practice 3d and co-wrote Norton Creditors' Rights Handbook (Thomson/Reuters). He is a Fellow at the American College of Bankruptcy, a past-president and Emeritus Board member of the American Board of Certification, a past-president and founder of the Tennessee Turnaround Management Association, a past-president, board member and frequent speaker at the Mid-South Commercial Law Institute, and is President of the Norton Institutes (www.nortoninstitutes.org).

Mr. Norton is the current Chair of the Subcommittee on Individual Chapter 11s in the ABA Business Bankruptcy Committee in the Business Section of the ABA.
